At On the Mount (referred to as “our”, “us”, or “we”), we want to be crystal-clear about the services we offer as well as the obligations and options you have as our client or as someone who uses our Services (“Services” or “Service” collectively refers to our website or any form of work or labor we provide).

Our Terms of Service (hereby referred to as “Terms” or “Agreement”) are a legally binding contract between you and us. Our Terms govern your use of our website, as well as your relationship to us as our client. Your use of our Services means that you agree to be bound by these Terms. Please read these Terms carefully before using our Services. Do not use our Services if you do not accept these Terms.

Introduction

These Terms and all other legal notices or statements provided by us constitute the entire agreement between you and On the Mount. If any aspect of these Terms is found to be unenforceable, it will in no way affect the enforceability of any other provision.

Our failure to not enforce any aspect of these Terms or to respond to anyone’s breach of these provisions shall not waive our right to enforce any aspect of these Terms at any time.

Overview of Our Company

On the Mount is an all-in-one social media management company that serves churches, Christian ministries, and Christian influencers.

By all-in-one, we mean that we provide everything you’ll need to have an effective and growing social media presence: content creation, post scheduling, graphic design, video editing, optimization, and more. This gives you the convenience of not having to work with multiple companies or individuals for your various social media and digital marketing needs.

Overview of Services

The services you will receive from us are whatever you demand of us in any given period of one month as outlined in your invoice, in accord with the specific services you requested when creating your own package, up to a maximum of the number of services you selected in your package.

You are paying for the ability to have a maximum of the quantity of services in your package in any given month. Your package or payment of our services are not a guarantee that you will receive the full amount of services outlined in your package or invoice, nor a guarantee that you will receive any services at all, as it is the client’s responsibility to request those services each month.

For example, if you are paying for five graphic designs a month, you are paying for the ability to receive up to five graphics a month. Failure on your part to require from us the total amount of services you have purchased is not our responsibility, but the client’s. This means if you are paying for five graphic designs a month but only request two graphic designs from us in that given month, we are not responsible for producing three more graphics; the client must request the full amount in that given month.

Unused services will not be transferred to future periods, nor can services paid for in a previous period be requested outside of the month-long period outlined in the invoice. The services must be requested and used in the period they are billed for, as all of our services are produced and billed on a month-to-month basis.

No refunds are given for a client’s failure to request the full amount of services they are paying for, nor will On the Mount be held liable for a client not utilizing the fullest extent of the services they have purchased.

We are currently only working with clients who are paying $1,000 a month in services or more.

Description of Services

When You Will Receive Services

Unless otherwise mentioned, you will receive services any time you request them in the period you’ve been billed for. We do not deliver services outside of your billing period on a month-to-month basis. Unless you have ordered a one-time service, you will not receive services if you do not request them from us during that period with an end-date that is within that period.

One-time services, such as account optimization or any other service that is billed once rather than monthly, are worked on as soon as they are ordered.

Post Scheduling

Post scheduling involves us managing, scheduling, and posting all of the social media content for your accounts.

This means if you want a certain picture, video, or text post to be uploaded to social media on a particular date or time, we will do so. We’ll post content for you any time during the month you’ve been billed for. We require an advance notice of 24 hours for all post scheduling requests.

Graphic Design

We create graphics for any purpose your church may need: announcements, events, sermon series, quote pictures, Bible verse, and more. These types of services are provided any time during the one-month period of your billing with a three-day turnaround (unless the graphics are to be posted at a later date; in these situations, the graphics will be finished by that date). We’ll work on up to two graphics at a time.

Revisions

It is reasonable for a client to suggest one to two rounds of revisions for any graphic design. At the sole discretion of On the Mount, if we deem that a client requests an excessive number of revisions, whether for a single graphic or as a whole over multiple graphic design projects, we reserve the right to charge extra for the additional work involved. By agreeing to these Terms, you agree to pay for these extra services if this situation occurs.

Video Editing

We edit any video footage of any length. Video editing may include:

  • Color correction, where the colors of the footage are adjusted to look more visually appealing
  • Audio balancing, where we balance all of the video’s audio to be at an optimal decibel level
  • B-roll all throughout to make the content more engaging
  • Audio reparation, where we remove humming, echoes, or other unwanted noises
  • Text animations and titles, where we add text graphics for introducing speakers, writing Bible verses, or any other use
  • High-quality transitions, where we add engaging and professional animations to switch from one scene to the next
  • Other basic editing, such as removing portions of content, zoom-cuts, etc.

Unless the client has requested for the video to be uploaded at a later time, from the time the video editing project is requested, it will be completed within four business days. Otherwise, the video will be completed, at latest, the day that it needs to be uploaded.

We will work on one video editing project at any given time.

If we receive a request for a project that we, at our sole discretion, deem to be highly work-intensive, we reserve the right to charge extra for the additional work involved.

Revisions

We do not limit our video editing services to a specific number of revisions. It is reasonable for a client to suggest one to two rounds of revisions per video.

However, in the sole discretion of On the Mount, if we deem that a client requests an excessive number of revisions, whether for a single project or as a whole over multiple video editing projects, we reserve the right to charge extra for the additional work involved. By agreeing to these Terms, you agree to pay for these extra services if this situation occurs.

In the sole discretion of On the Mount, if we deem that a client requests revisions that are highly work-intensive and unreasonable, whether for a single project or as a whole over multiple video editing projects, we reserve the right to charge extra for the additional work involved. By agreeing to these Terms, you agree to pay for these extra services.

Video Clips

This service involves going through your video content, finding a potent sub-60 second clip, making it vertical, and optimizing it with a variety of engaging edits such as burned-in captions, b-roll, and more in order to achieve high levels of reach and engagement. These are completed within four business days, or by the day the video clip is requested to be finished; whichever is longer.

Revisions

It is reasonable for a client to suggest one to two rounds of revisions for any video clip. At the sole discretion of On the Mount, if we deem that a client requests an excessive number of revisions, whether for a single video clips or as a whole over multiple video clip projects, we reserve the right to charge extra for the additional work involved. By agreeing to these Terms, you agree to pay for these extra services if this situation occurs.

Optimization

Optimization is presenting content in a way that enables it to get more views or engagement (likes, comments, etc.) than it would normally. Optimization is key to growing social media accounts.

It includes crafting compelling titles for videos, rephrasing text descriptions for posts, using effective hashtags, placing keywords in descriptions, and more.

We cannot guarantee that your accounts will grow in any way if you order our optimization services.

Other Services

  • Comment interactions: We will engage with comments (for example, “liking” a comment) and respond to comments on your behalf. You do not need to request this work from us; we will work on it right away for the month you’ve purchased it in.
  • YouTube channel networking: This involves us engaging with the communities of other YouTube channels that you select. It allows your YouTube channel to gain more exposure and grow faster. You do not need to request this service once you purchase it.
  • Account/channel optimizations: We will update and optimize the account or channel of your choosing. There is a three-day turnaround for this service from the moment you order it.
  • Ad campaigns: These are paid social media ads that the client funds. These allow specific posts of your choosing to reach your target audience for a fee. The turnaround time is contingent on the amount of other work needed for each specific campaign, such as additional graphic designs or video editing.
  • Monthly reports: These outline the most important metrics of your social media accounts for you to quickly see how your outlets have been performing. They also will summarize the amount of work we’ve done for you.

Refund & Cancellation Policy

We offer full 30-day refunds/cancellations for all of our services. The sole exception for both refunds and cancellations is in the case of one-time services where we have already delivered the product.

For example, if you order a video edit and we have already edited and delivered the final video, we will not refund your purchase. However, if you wanted to cancel your order before the finished video is produced and it’s within seven days of your order, you would receive one.

Our Rights

Our Right to Refuse Service

On the Mount reserves the right to refuse service to anyone for any reason in accordance with applicable laws.

Our Right to Terminate Access to Our Services

On the Mount reserves the right, at our sole discretion, to deny, restrict, suspend, or terminate your access to our Services for any reason.

By being our client, you consent to allow us to terminate any contractual obligation we may have with you for any reason, and you agree to receive a prorated refund.

Our Right to Change Prices or Terms

On the Mount reserves the right, at our sole discretion, to modify the price or terms of any Service we offer at any time. For example, we may choose to adjust the cost of graphics, or we may adjust the turnaround time for video editing.

Any changes we may make will go into effect the next monthly charge you incur.

Client Code of Conduct

When using our Services, including being our client, we expect a certain level of behavior. Here’s some rules we expect all of our clients or users to abide by:

  • Keep it clean. Don’t engage in any act that may expose us or any of our Services’ users to any type of harm. This includes not engaging in any activity that may disrupt, overburden, disable, or otherwise tamper with the functionality of our Services. Don’t attempt to circumnavigate any security features we have or use any automated technology to interact with our Services.
  • Be respectful. Please don’t communicate with any member of On the Mount in any way that is deemed inappropriate or hurtful at our sole discretion. Do not send (via emails, texts, or any other medium by which information is communicated) any viruses or content that is illegal, misleading, malicious, inaccurate, or otherwise objectionable, or that violates any applicable laws. Don’t impersonate any person or organization.

Ownership of Content

Unlike most companies, individuals, or agencies, we grant you the copyright for many Services we provide you.

The following is an all-inclusive list of the content that you receive the ownership and copyright for upon completion and transfer of such content:

  • Graphics. This includes quote graphics, event graphics, announcement graphics, thumbnails, and profile or banner images, but does not include monthly reports, invoices, or any other graphic.
  • Videos. This includes any and all edited videos we provide you with.

Although we transfer all ownership of these works to you, you consent to allow us to use any of the products or services we’ve created for you for marketing, social media, or other purposes related to On the Mount, without limitation.

Warranty Disclaimer

While we strive for excellence in everything we do, our Services are provided “as is,” meaning we cannot guarantee that:

  • Our site will always be online and working properly.
  • You will enjoy our Services.
  • Our Services will be error-free, that we will have any defects corrected, or that our Services are free from any viruses or anything else that is potentially harmful.
  • Our Services are fit for the specific purpose you bought them for.

To the maximum extent of the law, you are solely responsible for any damage to your device that results from using our Services. 

Limitation of Liability

Under no circumstances will On the Mount, our affiliates, or any party involved in producing or delivering our Services be liable for damages or losses that occur as a result of you using our Services in any way. This includes, but is not limited to,  direct, indirect, incidental, consequential, special, or punitive damages or losses that result from these Terms or from your use, access, misuse, or inability to use our Services. This includes, without limitation, any On the Mount content or any sites our Services link to, however caused, even if we have been made aware of the possibility of such damages.

In certain jurisdictions, the exclusion or limitation of incidental or consequential damages is not allowed. In such cases, On the Mount’s liability for such damages shall be limited to the furthest extent allowable by law. Any claim against us will be limited  to the amount you paid for the Services (if any).

Depending on the laws of the appropriate jurisdiction, including the State of California, some of the aforementioned exclusions and limitations may not apply to you. In such cases, the exclusions and limitations will apply to the greatest extent allowed by the applicable law.

Amendments to This Agreement

We may need to make changes to these Terms occasionally for various reasons, including but not limited to, reflecting updated practices or pricing, adding clauses related to new Services, updating the wording, or abiding with new laws. We are legally entitled to altar this Agreement.

If we make a change to these Terms, it will go into effect 30 days following either your reception of communication from us regarding the update or our posting of the amended Terms on this webpage. You are responsible for periodically reviewing this page for any updates or amendments. The date of when our Terms were last updated appears near the top of this webpage for your convenience.

By continuing to use our Services or commence business with us in any way, you will be deemed to have agreed to and accepted any changes made to these Terms. If for whatever reason you disagree with these Terms or to any updates made to this Agreement, you must discontinue using our Services immediately.

Governing Laws

You agree that these Terms are made and entered into Orange County, California. You also agree that California law governs the interpretation of this Agreement and/or any dispute arising from your access to, dealings with, or use of our Services, regardless of conflicts of law principles.

Any lawsuit made against On the Mount regarding any matter related to our Services must be brought in the courts of Orange County, California. You also agree and understand that you will not bring any class action lawsuit related to your access to, dealings with, or use of this Site against On the Mount, or any affiliated employees, officers, agents, directors, or entities.
